i'd agree. it may well be that he is being an anal fucker, and that he wouldn't have noticed the difference anyway, but since you did actually make a 'mistake', you dont have a leg to stand on. Or more accurately, you should give him the benefit of the doubt.

i'm sure you could argue your case and get away with it. But i guess its the principle that's relevant here.

thats a full on liberty to be fair, hes got to cough up even more money cos you blatently lied and hoped he was a mug, but he will be happy just to get one that aint scratched up so let him send it back at his cost and you send the other one out at your cost.

Same sort of thing happened to me recently. Sold a t-shirt, listed as a 40" chest, it was in the men's section etc. Sold for about £12 to somebody in the US. When the girl received it she told me it was a fake and she wanted to send it back blah blah blah. I proved it wasn't a fake and then she started saying "what am I going to do with a men's t-shirt?" like it was my fault she hadn't read the listing!

You listed it right, they read it wrong so no refund. Just tell them to stick it on ebay themselves if they want their money back

no,,its described as "almost new" listed in the "used" category, and has very minor surface scratches (although they are not apparent in the photographs)

if he went through paypal, they would force him to sent it back first (and at his own cost)

Yeh that was it, thing is some people buy stuff off ebay for gifts - so if in the pics it looks new with no scratches then dude might buy it as a gift for his mate or something, - then it turns upo with scratches and he cant give it, you get my gist.
