official bottom line is she is trading.

http://www.hmrc.gov.uk/guidance/selling/badges.htm

Its double bad as she doesn't work (eg no PAYE or national insurance coming in on her records for the tax years).

If you are trading you may have to pay Income Tax and National Insurance Contributions (NICs) and VAT, and we will treat you as self-employed in that trade.

She can either keep going and hope she don't get found out and basically get into trouble for tax evasion (no wesley snipes) or become self employed.

The basics are showing how much profit she makes and declaring it.

everything on this exact topic is in this link:

thanks mate, its to tricky to just hope anymore, its all changing on may 1st, thats why im asking…you have to declare if you are not selling as a normal punter shifting out unwanted shizzle wise, thats why im asking…i think taking the gamble is suicide in a wesley stylee.

If they are making you declare than its game over.
EDIT:
Some concern maybe required if she has not paid any tax or NI for a year or so and then suddenly says she wants to become self-employed, they are not stupid. Cry

Also, you need to send the phone (not to Nigeria) via special delivery, and not recorded, as you have listed in your auction. And it will cost more than £5 to post

Cancel them buy going here and entering the item number 260232404744 and enter in the user names you want to cancel. It removes them instantly.

As Noble said, do the top two bidders and you should be fine. I would keep an eye on it right until the end though and make sure that no other dirty scammers jump on your listing.

p.s if you get any emails saying you have won the worldwide lottery that you didnt even enter, or that someone will give you 30% of a 10 million pound goldmine sale if you put the money in your bank for them, neither of them are true either, so dont send them your bank details and pin number. Laughing out loud
